Drug charges tend to fall into one of two categories: misdemeanors and felonies.
Misdemeanor charges for possession of drugs such as marijuana, ecstasy (XTC), and methamphetamines will not result in jail sentences and the charges may be dismissed if you and your attorney take the proper steps. Our lawyers have extensive experience in helping drug users receive treatment rather than jail time. Our lawyers also have experience representing clients in medical marijuana cases.
For misdemeanor possession charges, our lawyers seek opportunities for diversion programs which take you out of the criminal justice system and focus on treatment. If drug treatment programs are pursued, our lawyers can put you in the position where the charges will be dismissed. We have also successfully helped clients who have not been eligible for drug diversion programs.
Drug distribution and selling drugs are felony charges, which carry a possible state prison sentence. In these cases, our lawyers have a high rate of success in motions to suppress drug evidence by attacking: 1) the legality of a search warrant; 2) the search itself; and/or 3) the detention of a client. If successful, these motions can lead to a dismissal of charges or reduced charges.
