DUI charges carry criminal consequences that can include a fine, jail time, and a probationary period. A DUI arrest also has serious consequences for your driver's license. Those consequences come not only from the criminal DUI charge but also from a related administrative action by the California Department of Motor Vehicles (DMV). Unless you or your attorney requests a hearing with the DMV within 10 days of your DUI arrest, your driver's license will be automatically suspended.

As your DUI attorney, we will do everything we can with the court and the DMV to prevent your license from being suspended. In more than 50 percent of the DMV hearings in which we have appeared on behalf of our clients, we have been able to persuade DMV hearing officers not to suspend our clients' licenses. In other cases, we have been able to help our clients obtain restricted licenses that allowed them to drive to and from work.

In DUI cases, it's very important for your lawyer to investigate technical defenses, such as the conduct of the police officer who stopped you. If you were not stopped in a legitimate and lawful manner, or if the field sobriety test was not administered properly, we may be able to get the charges dismissed. Our lawyers will also examine blood test results and breath test machine records to see if we can have that evidence thrown out. We work regularly with experts in blood tests and breathalyzer maintenance and calibration who will testify in your defense.

If you are arrested for driving under the influence you are required by law to take a chemical test. This is true even if you blew into a portable breath machine prior to your arrest. If you refuse to take a chemical test after you have been arrested, you will face a longer license suspension or revocation that you otherwise might.

Officers are required to offer you a blood test or a breath test. Although officers are not required to offer it, you can request a urine test as well.
