In California, DUI laws give you the option to take a blood or a breath test (you also have the option of a urine test though the police are not required to offer it to you).

A blood test is the most reliable. It also has the possible advantage of preserving the evidence so your attorney can ask for it to be retested later if there is a potential that a problem occurred. Retesting a blood sample ensures the initial blood alcohol test was done correctly. It can also identify problems with the initial test.

There are several steps in the process when a blood alcohol test can run into problems.

• If the person taking the blood sample is not properly trained: The State of California requires the person taking the sample to be a certified nurse or phlebotomist. If the test is taken by someone who is not qualified, your lawyer may question the validity of the test results.
• If the blood sample was not promptly and properly mixed with a preservative: If it's not preserved, fermentation could occur in the sample and you could end up with a much higher blood alcohol content in the sample than was in your bloodstream.
• If the sample was contaminated: This could happen at the time it was collected or it could occur in the lab. Some labs are less competent than others. Your lawyer will review the qualifications of the lab personnel and the testing procedures to ensure the blood alcohol test was handled properly.
